1. Acceptance of Terms

By downloading, installing, accessing, or using Infinity Tools under a free license (“Free Version”), you (“Licensee”) agree to be bound by this Community / Private License Agreement (“Agreement”).
If you do not agree, do not install or use the Software.

1.1 Definitions

“Licensor” means Smart In Venture GmbH, Gleueler Str. 245–249, 50935 Köln, Germany.
“Software” means Infinity Tools and all related software components, scripts, installers, documentation, and accompanying materials.
“Server” means a physical machine or a virtual machine instance (“VM”), including cloud instances, that runs the Software. Each VM counts as one Server, even if multiple VMs run on the same host.
“Machine ID” means a unique identifier generated from system parameters to bind the Software installation to a Server.
“Documentation” means official manuals and product descriptions published by the Licensor.
“Commercial Use” means any use that directly or indirectly generates revenue or supports professional or organizational activity, including use by companies, public entities, associations, or freelancers in their professional capacity.

2. License Grant (Free, Non-Commercial)

Subject to compliance with this Agreement, the Licensor grants the Licensee a non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software solely:

for private, non-commercial purposes, and/or

for evaluation/testing purposes,
provided that usage remains within the server limit in Section 3.

The Software is licensed, not sold. All rights not expressly granted remain reserved.

3. Server Limit (Max 3 Servers)

3.1
The Free Version may be installed and used on a maximum of three (3) Servers in total.

3.2
Each VM or cloud instance counts as one Server, even if multiple instances run on the same physical host.

3.3
If you require use on more than three (3) Servers, or if you require any Commercial Use, you must purchase a Commercial License.

4. License Binding / Activation (Optional Enforcement)

The Licensor may provide or require an activation mechanism that binds the Free Version installation to a Machine ID.
You may not circumvent, remove, disable, or interfere with any licensing or activation mechanism.

5. Restrictions

The Licensee shall not:

use the Software for Commercial Use,

resell, rent, lease, sublicense, distribute, or otherwise transfer the Software,

make the Software available to third parties as a hosted service,

reverse engineer, decompile, disassemble, or attempt to derive source code, except as permitted by mandatory law,

remove copyright notices or license enforcement mechanisms,

use the Software unlawfully or in violation of third-party rights.

6. Ownership

The Software and all associated intellectual property rights are and remain the exclusive property of the Licensor.

7. No Warranty

To the maximum extent permitted by law, the Free Version is provided “as is,” without warranty of any kind.
For Consumers, statutory warranty rights (where applicable) remain unaffected.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

Unlimited liability for intent, gross negligence, and injury to life/body/health.

For slight negligence, liability is limited to breach of essential obligations and to foreseeable typical damage.

For the Free Version, liability for slight negligence is capped at EUR 100 per claim.

Nothing limits liability under mandatory law.

9. Termination

This free license is revocable. The Licensor may terminate this Agreement immediately if the Licensee breaches the terms (e.g., exceeding the 3-server limit or commercial use).
Upon termination, the Licensee must cease use and delete all copies.

10. Governing Law

This Agreement is governed by the laws of the Federal Republic of Germany, excluding CISG.
For Consumers, mandatory protections of the law of their habitual residence remain unaffected.
